| 老字号维权难，侵权的罚太少了。一位老字号经营者感慨。近日，最高法对北京庆丰包子铺（以下简称庆丰包子铺）状告山东庆丰餐饮管理有限公司（以下简称庆丰餐饮）侵害商标权与不正当竞争一案，作出再审判决：被告庆丰餐饮立即停止使用庆丰标识等侵权行为，并赔偿原告庆丰包子铺5万元。 历时3年的北京庆丰与山东庆丰的傍名侵权案尘埃落定。但老字号维权的战争能否因此画上句号，仍有待观察。从一些老字号维权的实际效果看，李逵打赢官司，却挡不住李鬼继续侵权。 维权3年获赔5万 与庆丰餐饮对簿公堂，是老字号庆丰包子铺第一次通过诉讼手段进行维权。得知胜诉的消息，庆丰包子铺常务副总经理徐林和一些加盟商都表示很开心，老字号品牌终于得到了保护。 徐林介绍说，2013年6月，庆丰包子铺准备进军山东开连锁，但由于庆丰餐饮公司在2009年就已注册使用济南庆丰餐饮管理有限公司，导致庆丰包子铺开店遇阻。庆丰包子铺认为，庆丰餐饮公司以庆丰字号营业，经营与北京庆丰包子铺注册商标相同和类似的商品和服务，这让消费者对庆丰包子铺与庆丰餐饮公司产生混淆误认，侵犯了庆丰包子铺的注册商标专用权。 据此，庆丰包子铺把庆丰餐饮诉至济南市中院，请求判令庆丰餐饮立即停止使用含有庆丰字号的企业名称；公开发布声明、消除影响；赔偿经济损失50万元及合理支出9万元。 不过，此案在济南市中院一审判决、山东省高院二审判决时，均判庆丰餐饮未侵犯庆丰包子铺的注册商标专用权。庆丰包子铺不服，遂向最高法申请再审。去年年底，最高法裁定提审此案，并于日前公布判决结果：撤销此前判决，认定庆丰餐饮侵权，并判其停止侵权，赔偿庆丰包子铺5万元等。 维权3年，付出巨大的诉讼成本，庆丰包子铺仅得到5万元赔偿。 李鬼侵权依然如故 庆丰包子铺不得不面临的一个现实问题是：赢了官司，但能否真正阻止李鬼继续侵权，仍是一个未知数。 同是老字号的内联陞就陷入这样的尴尬。 官司打赢了，维权还是没完没了。内联陞副总经理程旭介绍，去年年底，持续4年的内联陞状告福联升商标侵权案胜诉。但他发现，快一年时间过去了，福联升的官方网站仍在继续运行，而且不断更新加盟的消息，加盟店都在京外的三四线城市，几乎一天一个店开业。据了解，这家打擦边球的福联升注册地在北京密云。判决结果下发后，内联陞方面曾向当地工商部门举报福联升公司侵权，但至今也无下文。名字没改，照样活得好好的。程旭说。 更令人头疼的是，围绕着联升二字，对方竟注册了20多个商标，比如瑞联升、祥联升、步联升等。对方甚至还变着花样注册吉福联升、吉祥联升，甚至最爱福联升等商标。我们在申请一个个去撤销。目前已撤掉三分之一。但从提交撤销申请到最终完成，最迟也得半年。这让老字号陷入一场无休止的维权战争。 算上注册费和律师费，对方注册一个，大约花2000块钱，我们撤销，就要花10000块钱。程旭认为，相比侵权成本，维权的成本太高了。 跨区维权有点儿难 近年来，除庆丰包子铺、内联陞外，稻香村、王致和、瑞蚨祥、同仁堂等多家京城老字号，都曾被侵权。随着各家老字号对品牌的重视，李逵和李鬼之间的斗法更是让人眼花缭乱，有的老字号甚至不惜与李鬼对簿公堂。 但诉讼维权，也有些人认为成本太过沉重。据介绍，这几年算上诉讼费和其他开销，内联陞在维权上就花去五六十万元。徐林告诉记者，公司客服会经常接到一些消费者的举报，称发现假冒庆丰包子铺。对一般情况，庆丰包子铺选择通过工商途径进行打假，来解决问题。
